Welcome to FretTrain! These Terms of Service ("Terms") govern your access to and use of the FretTrain website and application located at frettrain.com (the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account, accessing, or using our Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the Service.

2. Description of Service

FretTrain is an interactive music education application that helps users learn and memorize fretboard positions on guitars and other stringed instruments. The Service includes:

Interactive fretboard visualization
Learning modes for notes, chords, triads, and scales
Quiz/testing modes with scoring and progress tracking
Leaderboards and achievements
Custom tuning creation (premium feature)
Multiple instrument support (premium feature)

3. User Accounts

3.1 Account Creation

To access certain features of the Service, you must create an account. You agree to:

Provide accurate, current, and complete information
Maintain and update your information to keep it accurate
Maintain the security of your password and account
Accept responsibility for all activities that occur under your account
Notify us immediately of any unauthorized use of your account

3.2 Account Requirements

You must be at least 13 years old to create an account. If you are under 18, you represent that you have your parent's or guardian's permission to use the Service.

3.3 Guest Access

You may use limited features of the Service as a guest without creating an account. Guest usage is subject to these Terms.

4. Subscriptions and Payments

4.1 Premium Subscription

FretTrain offers a premium subscription that provides access to additional features. By subscribing, you agree to pay the applicable subscription fees.

4.2 Billing

Subscription fees are billed in advance on a recurring basis (monthly or annually, depending on your selected plan). Payment is processed through Stripe. You authorize us to charge your payment method for all fees incurred.

4.3 Cancellation

You may cancel your subscription at any time through your account settings or the Stripe billing portal. Upon cancellation:

Your subscription will remain active until the end of the current billing period
You will not be charged for subsequent periods
You will retain access to premium features until the subscription expires
No refunds will be provided for partial billing periods

4.4 Price Changes

We reserve the right to modify subscription pricing. Any price changes will be communicated in advance and will apply to subsequent billing periods only.

5. Acceptable Use

You agree NOT to use the Service to:

Violate any applicable laws or regulations
Infringe upon the rights of others
Submit false or misleading information
Upload malicious code, viruses, or harmful content
Attempt to gain unauthorized access to our systems or other users' accounts
Interfere with or disrupt the Service or servers
Use automated systems (bots, scrapers) without permission
Harass, abuse, or harm other users
Use offensive, vulgar, or inappropriate usernames
Manipulate leaderboards or scores through cheating or exploits

6. User Content

6.1 Custom Tunings

You may create custom tunings within the Service. You retain ownership of any custom tunings you create. By sharing custom tunings publicly, you grant us a non-exclusive, royalty-free license to display and distribute them to other users.

6.2 Content Moderation

We reserve the right to remove any content that violates these Terms or that we find objectionable, without prior notice.

7. Intellectual Property

7.1 Our Intellectual Property

The Service, including its design, code, graphics, logos, and content, is owned by FretTrain and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service without our written permission.

7.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes in accordance with these Terms.

8. Third-Party Services

The Service may integrate with or link to third-party services (such as Stripe for payments). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for third-party services.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

MERCHANTABILITY
FITNESS FOR A PARTICULAR PURPOSE
NON-INFRINGEMENT
ACCURACY OR COMPLETENESS OF CONTENT
UNINTERRUPTED OR ERROR-FREE OPERATION

We do not guarantee that the Service will help you learn any specific musical skills or achieve any particular results.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FRETTRAIN AND ITS OWNERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

Loss of profits, data, or goodwill
Service interruption or computer damage
Cost of substitute services

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $50, WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify, defend, and hold harmless FretTrain and its owners, employees, and affiliates from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:

Your use of the Service
Your violation of these Terms
Your violation of any rights of another party

12. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination:

Your right to use the Service will immediately cease
We may delete your account and associated data
Sections of these Terms that should survive termination will remain in effect

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by posting the updated Terms on this page and updating the "Effective Date." Your continued use of the Service after changes constitutes acceptance of the modified Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.

15. Dispute Resolution

Any disputes arising from these Terms or your use of the Service shall first be attempted to be resolved through informal negotiation. If informal resolution fails, disputes shall be resolved through binding arbitration, except for claims that may be brought in small claims court.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and FretTrain regarding the Service and supersede any prior agreements.
